![]() The Division of Labor Standards and Statistics within the Colorado Department of Labor and Employment adopted final regulations on November 10, 2020, regarding equal pay transparency. The Colorado Equal Pay Act amendments will come into force on January 1st, 2024. The law, signed by Governor Jared Polis, modifies pay transparency requirements for job listings and internal promotion opportunities. Lawmakers are trying to address the gaps with Senate Bill 105, which cleared its last major legislative hurdle on Monday. Colorado’s Equal Pay for Equal Work Act (EPEWA) went into effect January 1, 2021. Colorado recently passed Senate Bill 23-105, which amends Colorado’s Equal Pay for Equal Work Act. ![]() But many women say they still face pay discrimination in the workplace. This program is geared toward in-house and outside counsel, Human Resource professionals, and other individuals responsible for employer policy formation, interviewing, hiring, performance evaluation, employee career trajectory, and employment-related litigation. Colorado businesses have been required to provide equal pay to employees performing the same work since 2021. By the end of this program, attendees will gain an understanding of how the Act is an outlier among pay equity laws and what they can do to bring their organizations or clients into compliance. While some of the regulations' language is ambiguous, there are concrete steps employers can take to limit the risk of litigation. Those traps include proactive notice and posting obligations, the far-reaching geographic scope of the regulations, now-outlawed common interview and employment practices, safe harbor pay equity audits, and more. This program will address both the more intuitive prohibitions and requirements of Colorado's pay equity law, as well as analyze the more insidious traps of the Act.
